No you don't, It is for North America only and Australians can only change their Region to European countries so it is impossible for us to get it... Frustrating how badly other countries are treated compared to Usa in terms of content.

That may work for South America, but I know that UK/Aus/NZ regions are on a totally different eShop. I don't know if this offer is available for the relevant handhelds in the Japan region, but they are also on a different eShop.
From what I'm told, the promo is not just US but all of North America. So Canadians have had no problems getting it AFAIK. I'm glad to hear South American countries can also access it.

except Australians (Uk and Nz aswell) get screwed over again, We can't change it to North America or any country that isn't in Europe. I don't understand this favoritism that is constantly appearing, it's a free game that isn't even available for regular purchase in my country so there is no profit loss at all just lots of disappointed fans or possible new fans.

Nintendo has different branches for different parts of the world.
To my knowledge there is a Nintendo of America, and an EU Nintendo. Look up which branch is your area and ask them. This is just a promotion from Nintendo of America. Other regions may or may not get it later, or may get something entirely different. It's not favoritism.

Man I remember this game. It was the shit. I gotta look for it now since you make me want to play it. It was a great game but sadly idk I remember that a lot of the game needed it to be co-op which was a pretty bad idea for the GBA.

EDIT: I got the info from my facebook page as was posted by a gaming forum. I do not have any Nintendo products to confirm anything. But after a closer look, the post does say North America only. The site page doesn't give any such impression though. You'd probably have to find out yourself.
EDIT 2: According to Xiiram's post below, you can apparently change your country ion your profile and download it. Hopefully he/she'll come back and explain it for everyone.
Edit 3: Lot of people are trying to figure out the way to change the country in their system but no result has been found yet. It will be really appreciated if someone can share the knowledge if it can be done and how.
