One thing to watch out for, is that in many states, insurance companies will not pay what it would cost to buy a similar vehicle, they will try to take what you paid for the vehicle and find any and every way of decreasing the value (through miles driven, slight scratches, even if they may be due to the accident, etc). It is really pathetic, but unfortunately that can be the state of things. You may have to get a lawyer in order to get fair value for your car.

Yes it was stop-and-go traffic and I was at the end of the backup on the freeway. I looked in my rearview mirror in time to see the vehicle and know it was going too fast to stop. He obviously wasn't paying attention to the road and slammed into me.
The whole trunk and rear bumper is completely caved in, and the brake system warning light was on, so I could only risk driving it far enough to get off at the next exit. Had to have it towed after that.

At least you seem to be okay. So what about his insurance? Here in Germany you wouldn't have to worry about anything, It clearly wasn't your fault, so the perpetrator's insurance would have to pay for everything you lost. Isn't it like that in Cali?

Yes it's like that too, and he did have insurance. The only thing is that if the car is deemed unfixable they will only give me the value for it at the time it was wrecked. Since I bought the car nearly new and kept it in excellent shape for five years, it would be impossible to replace for the amount they'd pay out to me.

sorry to hear thats happened to you mate. especially after you thought your bad roll was past you already eh :/ but on a bright side (as cliche as it sounds), nobody was injured and if you think of it, people get serious injuries in the most ridiculous of ways - i have a friend who broke a few ribs after falling off a chair so yeah. so getting out of it with no injuries whatsoever is awesome.
yeah i know its not all black and white and you might still have to spend tons of $ on your new car, but having a (relatively?) serious car accident where only thing thats wrecked is your car... it really could have been much worse (:

But see, my year started really bad too, and now everything (at least now) turned the completely other direction and it seems the last quarter of the year is the best i ever had!
If you stay strong and keep thinking positive, everything will be fine in the end.
And a for the GAs: Nobody needs that, real live is allways more important then the internetstuff.
Don't get me wrong, i like being here, i am enjoy reading in the forums and, from time to time, i can say something too.
But when something, regardless if its good or bad, happens in real life, i will allways prefer that.

Small bit of good news. The other driver's insurance called me and said they already accepted full liability for the accident. He only needed to follow up with my own claim adjuster.

Yeah, for rear-end collisions the person behind is found at fault 99% of the time. It might be a pain to look for a new car or getting yours repaired, but things could be much, much worse.

That's quite a bummer. Glad to hear everyone came out of it in one piece and no injuries though. Also, don't worry about GA's. RL needs come first. :) BTW, did you ever find out what exactly was going on with the other driver that caused the collision?

That sucks, glad to hear no one was injured though. Unfortunately it doesn't take alot to deem a car unfixable and from what you say I'm pretty sure it will most likely be deemed unrepairable but fingers crossed it will be fixable. If it's deemed unfixable then hopefully you find a good car you like for the amount you get from insurance. Maybe if you wanted to you could even get the same model car seeing as you get the current value for it and that's roughly what they'll be getting sold for, just an option.
Edit: Just read your other post, sounds like you've been having a rough time :( just keep your chin up and hopefully things get better for you soon.

Hopefully, you aren't too sore tomorrow, frequently whiplash is a day or too later pain, I found that out personally years ago in a similar incident... I looked in my mirror and saw the woman coming up behind me turned around yelling at her child in the rear seat... it annihilated her car, but I had an old Lincoln and it barely scratched it. Again no one hurt, so I went to work, the next day was a little stiff the next one after that I thought I'd need a wheelchair :P

Well, the good news is that nobody got hurt, so it's just a matter of money. Once the money is (acquired and) spent, you are (hopefully) back int he swing of things. Just make sure you don't get scammed when buying a new car. I've had that happen to me a couple of times, and it sucks worse than having your car totaled. (

With that streak of bad luck, I think you're now due for a streak of good luck. It probably already started a second after the impact - no-one was injured, and that's a huge break. It also seems the insurance claim is on the right track, with the other driver accepting their liability. I hope you get a new car that you enjoy even more than the previous one. That's at least how I prefer to look at things when something breaks and needs to be replaced, I try to see it as an opportunity to buy something nicer that I couldn't justify before.

i did a total lost once, but i got the replacing part for so cheap that it was more valuable to repair the car than changing it +- 500 $ in repair incluing the taxes, on that 250 $ just for the towing so wasn't that bad
they wanted me to declare it as a total lost but for the price of the repaire it didn't worth it, an air bag + thing that make it pop is about 1 000 $ with out taxes and delivery and labor, i got mine for 80 $ air bag + 50 $ for the detonator (not sure of the name) and 100 $ for the labor, did the rest with a sledgehammer

to place back the big metal beam in position, you unscrew everything attached to it then you smash it to re give it ''normal form'' because a normal hammer is to light for that, then you replace every metal pieces back to the beam by reforming them to there normal shape and you do that until your car look nice enough to be considerate fixed
Of course you need to hit the beam from the out side to push them out side not like the girl on the car on the next post
I made a face to face with the iron wall on the high way so everything on the left side was 2 inch deeper in the car then the right side, now might be 1/2 or 3/4 inches deeper but the head light is now in place so its doesn't need to be more shaped to be legal (missing head light lol)
well when your car worth +- 800 $ and only the air bag cost 1 000$ some time its better to get a new one but i made every repaire possible on that car so its pretty much a brand new car for a 1996 lol

on the bright side 2015 is almost over and 2016 can only get better.
I don't know what you were driving but i can recommend the 2008 Hyundai Sonata V6, i also heard VW are giving out some good incentives since they got caught cheating

Hey all.
Last night on my commute home from work I was rear-ended on the freeway. No injuries, but my car is currently out of commission and I don't have a replacement yet. The insurance has yet to determine if it's fixable or a total loss.
Yes, apparently 2015 is not done crapping on me yet O_o
In any event since I might need to go car-shopping in the near future, I will be a little less generous with the gibs in the coming weeks. I have some in my inventory and will make GAs where appropriate, mostly to the Christmas groups/efforts.
