Whole story:


FRIDAY:

My fiance started her own company 3 weeks ago. Last week she received a mail - inside was something looking like an official letter from government, with official stamps etc - calling her to pay 195 PLN (46EUR) for mandatory registration in "Polish Companies Registry. Below was a blanket to send money via bank transfer. On the other side of sheet of paper there was written with small letters that "This is just an advertisement. No payment is mandatory. We are not government agency, but just private company".


WEDNESDAY:

We went with that letter to police to report a fraud attempt. 1st policeman told us it's not a fraud, because there's this text on the other side. We said we'd like to report anyway and let a court decide if it's a fraud or not. He told us we'll have to wait for his supervisor.

His supervisor comes, we tell whole story over again - he says he cannot take our statement cause it's no Police work and we should go to civil court if we want to. I take out my smartphone and google through polish law codexes and show him a point that it's not a matyter for civil court but for the police. Very unhappy he writes down a statement then he asks me for a smartphone I just googled it on. I think he wants to copy what paragraph number it is or something, but no - he puts a smartphone into an evidence bag. WTF? - I ask. "You used your company's smartphone for private matters, which is against the law.". "It's not company's smartphone! It's my private phone. Plus I bought it over 1.5 year ago while company is up for just 1.5 week!". "In this case we will have to verify it - if it's really private smartphone, not a company one. You can take it back in 24 hours". "Can I at least have my SIM card back?". "No, SIM card is part of protected evidence now". He gives me piece of paper to come back tommorow for my phone.


THURSDAY :

I go to pick up my phone. They give it back to me - batterry dead. I go back t home, charge it - and what do I see? 26 calls made while phone was there, whole internet package used, shitload of some useless shitty apps from "money-for-download" pages installed. I go back to police to report it. What do I hear? "You probably made all these calls and downloaded all this stuff right now, while changing phone clock, just to blame police". For next few minutes I try to calmly resolve this issue - but I hear that if I don't stop talking I'm the one who they will arrest for fraud on them - as I obviously try to scam them for compensation right now. The moment I hear it I break - I scream on an idiot who tells me this that he must be a moron, that the fucking Android would change all timers the moment I'd change time, and that some fucking asshole from their fucking police station is just a thief that decided to use smartphone which was suposed to be evidence to save himself some money and earn some fucking credits on some shitty website for downloading shitty aps.

Next thing I know I lie on the ground handcuffed behind my back. They take me to prosecutors and I find out I'm charged with insulting police officer (because I used vulgar language) and resisting an arrest (yeah - me fat, unhealthy nerd resisted 3 bigass muscled cops who were lying on me and handcuffing me). And I hear I now face a threat of big fine or up to one year of jail time... So yeah - that's my story - if you read up to here the GA cove is hidden right after Thursday.


AFTER NECRO EDIT

OK... idk why the hell someone necroed such an old topic, you're an idiot dear sir, but as for update how things ended up:

  1. Prosecution refused to drop charges and insisted about getting case into court.
  2. Then to make the whole process longer they insisted on psychiatric evaluation - deciding it one month after the case started o.O then waiting 2 weeks for a visit to a doctor so the doctor after 15 minutes can tell that no, I'm not a psycho.
  3. In the meantime of all this bullshit going on the year ended.
  4. Right at the start of the new year prosecution suddenly drops charges because of "low level of harm towards society".
  5. Seems that it got so long, because t was easy case to booost statistics. Apparently they results are evaluated not solely on number of cases they solve, but rather on number of cases and how long they work on them. They had no case, but they were running a case anyway, so in stats they were working hard for society.
  6. I did not file a civil case, because the expenses I'd have to pay were just silly compared to almost nothing I could get. Return of my 2 days salary because that's how many days I couldn't work.

At first I thought "oh, another case where the police doesn't do the work due to law limitations" but that's really some crazy sh*t. O.O
Good luck on getting your case handled. I hope you still own that note for getting back your phone. It will be a helpful proof that it was kept at the police while purchases etc. were made.

there are quite a few reports of police making up their own stories just to boost off their statistics - at avg once or twice a month you will hear some story over the media. And some are really not even comparable to mine - like a kid caught by police as they claimed they've seen him dealing drugs at the street, got beaten on police station, both legs broken, went to hospital, got checked, accused police of beating him up while trying to get his confession - police claiming "he had his legs broken before we caught him" - so yeah, kid with 2 broken legs was casually walking down the street, dealing drugs until they caught him. Or another case from our capital city, where not police this time but City Guards were breaking parking laws, a reporter were filming them, they didn't know he was a reporter, told him to delete the data from phone, he refused, they attacked him (phone still recording, yet thaey couldn't unlock it as they didn't know the password), they took the reporter to the nearby forest and beat him. He promised he will not tell anyone etc so they left him there. They just didn't know he was reporter and everything was being recorded so he had a proof. Luckilly these guys from 2nd story because of these evidences were fired from the force.

Ofc it's not like all cops are power-hungry idiots etc, I myself enountered a few good ones, got some help etc, but problems with police / city guard etc overusing their power re sadly not rare cases in PL.

Normally I'm against the concept of having security cameras everywhere, but it seems that it could be beneficial in these cases.

I'll make sure to keep a low profile if/when I get to visit Poland...

yup. Disciplinary fired, so no police retirement, no quitting allowance etc, but also they didn't end up in jail. Still better than 1st case - bastards are still working and prosecution takes ages checking if there's even a thing to charge them with and deciding whether they want to.

wow, that's a pretty fucked up story. really sorry this happened to you. i hope everything turns out to be ok in the end. i can only advise you to take a lawyer and tell him what happened with your phone. they mistreated you in the first place. and you can prove it. you have the paper that proves they had the phone at the time the calls and downloads were done. so i am sure a lawyer can help you there. :(

yeah - there are stupid laws regarding using company property for personal use in PL. Because you can get taxes you pay for phone, car, gasoline etc returned our version of IRS hunts people who use company things for personal use. For example if you have company car and company paid gasoline - you can go to client using it, but you cannot go on vacations or do shopping in this car. If you get caught doing so you may pay pretty big fine.

Meantime - my friend's husband in Netherlands has got company car and he doesn't have problems with driving with it from NL do PL on vacations / holidays and so on :D :D :D

Once someone has stolen coal from our cellar. Police officeres weren't able to track these thiefs, even when it was snowing day before and there were clear, black tracks of where they were pulling bags of coal. Mind blown.

Same as they weren't able to catch thief in my higschool, who was repeatedly trying to stole something - weren't even able to take off fingerprints from crowbar >_< And they are suprised why people doesn't trust police, courts and so on?

You could have solve all that racket with one simple action. Contact the phone company from which you had the SIM, ask for a summary of given calls and internet traffic, combine the date/hours with the paper the police gave you for holding your phone, contact the press ... and there you have it. A clean case against the police.

well, you didn't read the topic, but I don't blame you as it's not only old but long as fck, so let me just repeat what I said before - it wouldn't solve anything for me. Because I was charged with insulting police officer and resisting arrest - in this case it doesn't matter if the arest and what they were doing was right or wrong, even if I had a proof of them using my phone it's not related to the fact that I have no right to insult police officer or to resist arrest even if I'm innocent. All the data from phone company would help would just be filing my own case against the officer - not related to my charges. And it would win me nothing - the cost of the case would be higher for me than anything I would be able to get.

I've read all of it and I understood that you insulted the police officer. I'm just saying that you were right to do so and after the charges went down you could have fucked them in the ass. You couldn't have escaped the charges but it would have been a nice comeback. The police, as in my country, is really stupid and usually legally abuse the civilians or on the other hand, they don't know jack about the law.

not in this country ;) In this country people who spent years in jail while being innocent win 90-120k PLN (23-31k USD) from govt for it. In my case I could fight in court for return of my salary for 2 days I was unable to work because of it all. The cost of the case, lawyer etc would be higher than the money I would be able to win.

Lesson 1:
Don't bother police for simple shit like that. Police will never go after those kind of mailers. Maybe a prosecutor or a regulator, but not ordinary police.

Lesson 2:
Never argue with the police. No good will ever come of it.

Lesson 3:
Don't ever, ever, ever, raise your voice or use vulgar language to the police, they WILL turn on you

Lesson 4:
Any issues you have with the police, certainly do not bring it up at the local station, who will be super-protective of their colleagues. If at all, bring it up with internal affairs or whatever the equivalent police supervisory agency is where you live.

Lesson 5:
Government prosecutors will (almost) always side with the police, be protective of police. Prosecutors rely on the police to do their job, so they need to stay on friendly terms with the police.

Sucked that it happened to you. Hope this is a lesson for everyone.
Note: I don't think all, or even most, police suck. Just a handful. But don't bother them with stupid shit.

This is why I mention that I come from a family of civil rights and defense attorneys whenever police get involved. It's amazing how quick they lose attitude and become polite after mentioning it.

Half the time they're worse scumbags than the people they arrest.
