I also know that kind of Gentlemens agreement is not going to happen it was more wishful thinking but in this case Lazy Guys can't be blamed anyway since the game appeared in their Bundle first and was given away afterwards.

I think legally it would be possible to put something along the lines "If we sell this game in our Bundle it can't be given away for free for at least a year." in the contract and to be honest given how oversaturated the videogame market is I assume most big Bundle sites have more negotiating power than the average Indie Studio (unless they have a really good game to sell and if they do why would they hand it out for free) but if Bundle sites would do it is an entirely different question.
But we as customers can still incentivize them not to put (previous) freebies in their bundles by simply not buying those Bundles... maybe over time they would learn.

I guess the problem is that the videogame market is complety oversaturated and too many people want to work in that sector so they hand out their games for free to buy a tiny shred of attention but I doubt it actually helps their games.
