It was free by mistake and it didn't last long.
Which is why you're still able to make giveaways for it.
Also, orlygift's keys aren't guaranteed wins, so it's not exactly free there either.
So, there shouldn't be any problems if you make a giveaway for it.

Well, orlygift sometimes gives out huge numbers of keys and sometimes very few.
I think the number of keys for that DLC were quite high, which is why it's understandable it would qualify to be removed from the list of games that can be given away here.
I really don't know where the line goes for this site for removal, because I remember a game being removed from the list when only a very limited number were given away on orlygift.
Either way, even if a lot of keys were given away by accident on indiegamestand, the game was not removed from the giveaway list.
If it was going to be removed, it would've been removed already..
And I don't know if a 1100 copy raffle on orlygift is enough for it to be removed now.
But obviously I don't run things here, I'm just speculating :P.

Actually on orlygift, if you don't activate your key, you can't enter anymore their giveaways.

Well you wouldn't get banned, you could get a short suspension at worst.
If you're afraid of getting punished, just wait a couple of days to see if the game gets removed from the list of games that can be gifted.
If the game is still on the list after the raffle on orlygift ends, I'd say it's safe to make the giveaway.

Basically, you type the game into that first box you see. If the game is still there, you can still create GAs of the aforementioned game. But there's no telling whether the game will be removed later because of being given away or not.
The bundle list you've linked is the list of games with reduced CV (contribution value) because of being bundled/have been discounted more than or equal to 90% of its original price. CV is something like an XP on Steam Gifts that you get by creating giveaways, btw.

It was given away for free on Indie Game Stand recently (I missed it, so I can't give you details about it). Usually, games given away are removed from the creation page. Dunno why it's still on the giveaway creation list, but I wouldn't create one since in the end the GA may get removed.

The time period on it was short, keys ran out pretty quickly, and while the dev / IGS didn't need to add new keys, they did for whoever added it to their account at that time.

If you BOUGHT it AND it's able to make a GA then you can safely make a GA unless it was given away recently as free.
