It's a private giveaway - he's free to stipulate rules and reroll according to them. The rule you're thinking of is for public giveaways.

edit: Correction. From the FAQ/Rules: Extraneous/special rules for giveaways require moderator approval. Public giveaways cannot have any special rules.
