Sounds like a good idea to me. Some people probably just think the game just wasn't added to the list by mistake and try to give it under something else as a 'fix' for the problem. If they could see, "Don't give this away because blah blah blah," they might not.

100% needed here. I was unable to give away around 80% of my steam gifts (NOT steam keys!) and it took me quite some time to understand, why the games were not on the list, even if other ppl were able to create giveaways with them 2-3 days before (turned out that some of them were given away for free in the last days and most in the past).
On the other side some games are just missing (some collectors editions) so ppl are forced to investigate the case for days or even weeks before they can finaly giveaway them as a "standard" edition and clarify the difference in their description.
Such a list with "removed" games would save a lot of trouble and even more time :)

Gameminer has a nice system where keys for free/exploited games can be given away, but their cost is zero and you earn zero XP. However, you can give away gifts at regular cost and normal XP because it's only the keys that are ever given en masse for free.

Whilst it would help to a degree it won't prevent the issue as people will still list them as something else to try and get more CV for them.

I've seen a few people create giveaways for free / exploited keys with the description "THIS ISN'T GAME X; I COULDN'T FIND GAME Y ON THE LIST, SO I USED THIS INSTEAD."
Obviously this is against the rules, but I assume they don't realize that (why would they announce it?) I think part of the problem is that there's no real indication why the game you want to give away isn't on the list. (Remember, the person gifting it didn't necessarily get it from the free giveaway and doesn't necessarily know it happened.)
Therefore, I suggest including non-giftable games on the list, but having the system display a "You cannot give away this game; it is available for free or has been otherwise exploited" if the user selects them. That'd make it more clear what is going on.
