Bundle on steam are one upload for all games, so if you have a game in the bundle already, the copy if it goes to "waste;" you don't get a copy to gift. One reason why many people ask people to not enter if they have games in the bundles. =)
If you're doing individual keys and they have it, then you can always leave the one out!
According to the rules, a giveaway winner already owning one or more games in a pack is grounds for a re-roll if the giveaway creator feels it is warranted. Basically it's up to the giveaway creator's discretion to decide what is acceptable or not.
Indeed, be it the Valve complete pack or one of the Indie Bundles, the potential for a wasted game means that the giveaway creator has the ability to object to the person winning.
