I think it's okay as long as the winner gets the game that the giveaway is for. The rule is about giving away a completely different game as something similar e.g. Guns of Icarus Online as Guns of Icarus.

I think he says that he'll give the season pass ON TOP of the game, so that's just plain generous of him: he could've created a separate GA and gained the extra CV, if that's what he's after.
Also afaik giving away the wrong game would get him suspended, not banned
