Actually it's not restricted anymore since 2012, but Rockstar doesn't care, so it's still unavailable on Steam in our region.
But Steam Keys are also available at other places like Fanatical or Gamesplanet UK.

Yes. Region Restrictions can be confusing, but as far as I can tell Keys for just the first Max Payne Game should work in Germany.
