Because Valve does not give two fucks about old games. neither does UbiSoft.

There is also a good chance you need DxWnd to force it to windowed as it runs like ass in fullscreen (and stretches too): https://sourceforge.net/projects/dxwnd/
And to not make it lag like hell, most any systems need D3DOverrider: https://community.pcgamingwiki.com/files/file/84-d3doverrider/

I played it a couple of months ago (but the retail version) and the game worked fine in fullscreen, so it might be just a localized problem.
