Why would you believe such nonsense? If there was an option to trade already activated games on Steam, don't you think people would use it?

If the giveaway ends before it is removed, you'll have to live with your profile indicating you've posted a giveaway and never sent the winner their gift. That's appropriate punishment for failing to use your judgement. I wouldn't discount getting a suspension in the future, when your case gets reviewed.
Next time, you may want to read the FAQ instead. It states clearly you can't give away games from your library. Actually, it says so right in the 'create new giveaway page' too.

well there was a law passed last month that allowed for the resell of all digital media, valve hasn't put it into effect and i don't think they will in the near future but sites like GMG have had trade ins for a long time

That law was a European law, I live in Europe and on the last update of steam they forced me to accept thtat all the steam games have been bought on the kingdom of Liechtenstein, I bet outside the UE jurisdiction.
So that has been valve's movemeent.

SuddleD, you have never "owned" a single piece of software unless you have created it yourself. You "own" a license to use said software. It has been this way forever and you only need to read the EULA for any piece of software to understand this fact.
