Terms of agreement/service - Are just that. Terms that you both agree to.
They are not lawful and are only legally binding while both parties agree to it.

TOS are worth about as much as the paper they're written on (or not in this case).

What you're affective doing when purchasing a digital item, is offering a good will gesture to the provider of the digital goods as a replacement for a exchange of currency with the sale. Since nether of you offer a tangible good for exchange, it's hard to even call it a sale as such.

It's certainly legit to sell your account. No one can stop you from doing that, even if its licensed only software. However, they are within their own rights to block the account at their end if they don't want to agree for the account to be used by the 2nd owner.

Legit doesn't mean "is it possible and do I have the ability". It means within the rules or guidelines, in which case it is not according to Steams rules and guidelines.

Video games are in a grey area. The EU court ruled it but there are still no lawn about it. At least in the countries I know about. Stuff like this takes time.

The law is valid. The fact that this law is still young does not make it any less valid. In the case of Steam, however this doesn't really matter since it's against the TOS so the account will be banned anyway

According to the law you should be able so sell it. But you're likely to have to slap Valve around a bit as they think individuals are pushovers.

If you wouldn't legally be able to sell an account they would have closed everyone selling pre-owned years ago. But it's legal so they can't do too much, expect a bit of harassment though.

but this means only for softwares not for accounts or services

It's against the ToS for the account for it to be sold (i.e. they can ban your account for selling it).

But it's not illegal as in the police won't come and smash down your door and drag you away if you did sell your account...

In EU? Yes and no.

EU laws say you should be able to resell licenses you own (since you don't really own the software). Valve says "no".

If Valve found out you bought/sold an account, they would probably ban your account. You will have to end in a court to uphold your rights, as Law > TOS, but there are expenses. So, it probably isn't really worth it.

Change of credit card information if the buyer wanted to buy something would certainly raise flags.

Change in IP address and computer used to access the account as well, that definitely is tracked to determine region. Computers do have identification that is kept track of in login records, otherwise something like Steamguard wouldn't work.

Also, turning off Steamguard and then the information changing would raise flags as well. More than likely there is a set of factors that would cause Valve to determine stolen or sold account.
