So yeah, we've all heard the stories about people getting SWATted as a prank or as payback. I mean, there's these threads as well as other stories from around the internet.

This isn't funny at all, because sending over a team of armed police who are expecting the worst is deliberately putting someone else at risk of injury or death. (That by itself makes it a criminal act called Reckless Endangerment in a lot of countries).

So yesterday and today, an incident happened where an innocent bystander got shot, apparently over a disputed $2 bet over a video game. (Some Call of Duty, not that the exact game matters for the big picture.)

The guy who made a call is arrested already - and facing felony murder charges (and since he already admitted he made the call, should be an easy GUILTY verdict, unless jury will be swatters too...), with his history of fake bomb threats might even get terrorism charge.

Kinda wonder if the guy who was supposed to be a victim will get anything, for telling him to SWAT him.

it's not an easy verdict - felony-muder requires an actual felony that results in murder. In California, prank 911 calls are misdemeanors. In Kansas, "giving a false alarm" is likewise a misdemeanor.
So no felony-murder option there

Reckless endangerment is another option, but that too is a misdemeanor in Kansas. I can't find the relevant statute in California quick enough, but presumably it's a misdemeanor there too.

There are other theories under which a felony can be achieved, perhaps under battery. But that's not as straightforward as you may think.

From what I read around internets, calling 911 and lying you are a murderer and you are going to kill even more is a felony, not just misdemeanor (at least in Kansas).

I'd be happy to see which laws they're referring to. The ones I found for Kansas are:

21-6207. Giving a false alarm. (a) Giving a false alarm is:

(1) Transmitting in any manner to the fire department of any city, township or other municipality a false alarm of fire, knowing at the time of such transmission that there is no reasonable ground for believing that such fire exists; or

(2) making a call in any manner for emergency service assistance including police, fire, medical or other emergency service provided under K.S.A. 12-5301 et seq., and amendments thereto, knowing at the time of such call that there is no reasonable ground for believing such assistance is needed.

(b) Giving a false alarm is a class A nonperson misdemeanor.


21-5429. Endangerment. (a) Endangerment is recklessly exposing another person to a danger of great bodily harm or death.

(b) Endangerment is a class A person misdemeanor.

From some article on Internet: "In Kansas, it is a misdemeanor to make a false call for emergency, fire or police services. It's a felony to use an electronic device or software to conceal the caller's identity.

It's a more severe felony if the call falsely claims to be about violent crime or an immediate danger to a person. While a 13-month prison sentence is possible, the presumed sentence is probation."

But then, they might lie or just throw big words around, so you might be right.

considering how frequent fake swating is, you would think highly trained professionals would do a better job identifiying non armed civilians, before shooting, let alone without warning.
and still no expectations of this incidents from stopping, because everyone asks random lunatics on the internet not to endanger others, rather than identifying fake reports.

Can someone explain why the cop opened fire immediately ? I mean, they were told it's a hostage situation. Why would a captor open up the front door? Also, he didn't have a gun on him? Of course it's that idiot's fault that an innocent man died but that cop is just as guilty if you ask me.

According to the news articles, the cop didn't really fire immediately. The man opened the door, put his hands up when prompted, then kept lowering and putting them up a few times. Until it may have looked like he pulled a concealed firearm, and that's when the fatal shot got fired.

Unfortunately, the police in USA have a realistic expectation of suburban family homes harbouring substantial arsenals and people that think they need to deploy them. Consequently, for self-preservation purposes, they have developed lethal response tactics. I don't think there is any way back from their militarised policing while the populous maintains its phobia of armed home invasions (with a little encouragement from the NRA) and Rambo fantasies of one man army solutions (supported by zombie horde games and movies).

From what I read, he called saying "i shot my parents with concealable pistol, i put my sister in the closet and will kill her soon especially if i see a cops, I also plan to blow whole building up".

If this is true, then the scenario this fucker created over a phone was truly evil - "mad man will die anyway, cops have to decide how many goes with him, no time to properly check situation because of explosion threat..."

Keem is a terrible person but for this occasion I decided to listen to the interview with this SWAuTistic person. This man claiming multiple times that he isn't responsible because he was told to SWAT someone is just... mind-boggling. And the fact that he seems to genuinely believe he isn't at fault in any way. He goes on to say that if he was in a court room with the family of the victim, then he'd be sorry but not that he feels sorry for his part now... I just...

I believe that both the cops and the caller is at fault. Cops are not allowed to shoot to kill unless someone was holding weapon of threat. This is a serious crime by the cops for killing without confirming about the situation and the caller is also at fault for giving incorrect information. Both the cop and the caller is guilty for this crime!

Let me just say this... in New Mexico, they sicced a police dog on a mentally ill man living in the mountains who then made a "threatening gesture" so they shot him and he died. This is not the first time a mentally ill person has been killed by police. so yeah, throw in fake damning evidence against an innocent person that has not one clue why the police are showing up at their door and you have a recipe for wild west behavior and death. At least with a sane guilty person, they know to bow to the long arm of the law but innocent people don't have the same "oh shit! I better throw myself at the mercy of the "gods" showing up at my door" kind of response.... Even in 2017/2018, the cops have an adrenaline-fueled response that tends to result in death. Innocent people expect the police to be reasonable but they are frequently not... especially if they think they are going into armed situations.

All of this horrible news could be mitigated with better training by police departments but sadly the people showing up to take these jobs (which are under-paid and severely lacking in the kind of training that saves lives) are the kind of people that tend to shoot first and ask questions later. Which is not to say that most experienced law enforcement officers are bad - just that most of them receive inadequate training and it can take years to become "good" at their jobs.
