This. It's not the best of the ways, but I downloaded Skyrim from ThePirateBay to test it out before buying it on Steam.
(And I did bought it after playing it a bit, as you can see in my Steam library.)

I disagree, these companies need to be held responsible for their products, and if the product is not what is expected, then someone should be allowed to return it. This is especially true for digital goods, which have a form of DRM which can prevent the customer from using the product after the return, which is exactly what steam has. Of course the return should be within a reasonable period of time after the sale of the product to prevent abuse, except in the case of un-opened gifts which should be returnable for as long as the gift has not been opened or transfered to a third party.

Well if the game is buggy and has no demo version (like this one), you should be able to get a refund, but I don't see why would you be able to ask for a refund on a game with demo version or on one with no issues other than you found out meanwhile you don't realy like (for example there was one guy whining on warband forums one month ago that he wants a refund because the graphics are bad - what do you think abou that?). Instead I think you should be able to trade your games with less than 1-2 hours of gameplay.

If I buy any physical product, in the store, I have the option to return it for any reason at all, as long as it is within the return period the store allows. The same should be allowed for games sold on steam. Now I would not say the same thing for DRM free downloads, as there is no way to police whether or not the product is being used after the return.

That is not necessarily true, if I buy food, which does not have any "re-play" value, I can get a refund if I return it.
Edit: plus Steam could easily control returns like you are suggesting, by placing a play time requirement on returns, since they obviously keep track of that.

No, you do not (neccesarily) have that option. That stores in most cases allow you to, is a different story, and is to keep customers happy. Or in other words, stores don't have to accept a return. Unless of course they state that themselves in their polices.
But there is no law which tells stores that you may return something to a store if it is not to your liking. In fact, the idea of not being able to check a product thoroughly before purchasing, is the sole reason that stores have to accept it if you return an item when ordering it for example online, instead of buying it in a physical store.
Games are a though subject here though, because you can pretty much get as much information about the game in a physical store as you can in a digital store.
A defective product is something different of course, we are talking about a product not being what you expected here.

I bought a game on accident (was buying it for a trade) and they refunded me because i didnt download it/launch it so yeah i thought that was pretty nice of them

I'd love it if Steam let you get refunds on stuff you recently bought and haven't played. I just bought the pack of Doom 3 for $3.25, now I'm kicking myself because I could have gotten the BFG Edition which throws in Doom 1,2, and a bonus level for about $2 more.

There were cases in which users got their money back with the help of Consumer Protection and Distance Selling Regulations (included in the Directive of the European Parliament and of the Council) law.
Should Steam Store make any exception from refunding ?
