Well, sometimes you get a total asshole that marks "Not Received" even though you sent the gift and you know they've redeemed it.
So I'd say once you mess up 3 times you're out for good. Twice you get a suspension, and once you get a warning.

What about the other way around?

I've only created one giveaway in which I gave the winner the game and yet he never acknowledged it or willingly put Not Received as it clearly shows that on my profile.

According to the majority of these posts, I should be banned right?

Assuming you can prove you he did receive the game in question, then contact support and request your feedback be fixed and the user banned.
Any user who feels their banned should be able to contact support easily enough, I doubt they would refuse to listen to any legitimate grievances.

go to manage games and gifts and it will show who redeemed the gift, take a picture, send it to the mods and explain. It'll be corrected if true.
