Its possible they do a Steam revoke, but no one can answer this definitively. That will take more time to accomplish espc b/c its still the weekend. Play it or idle for the cards ASAP if it matters. I imagine that if you still have the game in a week, it probably wont be revoked.

Why does GamersGate never learn from their past mistakes?

Permalink

Comment has been collapsed.

Had redeemed on account. Couldn't get key as they had run out. Now removed from GG library. This isn't the first shit GG pulled. Shame on them.

-Edit because moralist outrage- I meant that Gamersgate should have had their act together to either a) prevent such a mistake from occurring or b) honour the results of their fuck up. This is contract law 101: that the price tag was a 'mistake' is not an adequate excuse to alter the terms of a deal made in good faith after the fact.

Yes, in good faith. The price tag is the terms of offer for the contract of sale. Once accepted the contract is in effect. While one can guess that a listed price point may be a mistake, if the customer does nothing to illegitimately alter the price point the vendor had set the contract is legitimate. If you went to a coffee joint and they listed their lattes at 0.00, it's not the moral or legal duty of the customer to confirm if this is a mistake or ask for a higher price point. It's the responsibility of the vendor to properly set their prices. This is similar to the reason why bait-and-switch tactics can be subject to lawsuit: wilfully refusing to honour an accepted offer.

Now, if Gamersgate had communicated that this free game was a mistake and would not be honouring the redemptions, that'd have been fine. It would have constituted a clear declaration of GG's unwillingness to trade (and thus preclude the possibility of valid contract). But where's the, say, twitter post about this? They have an account. They could have used that when their site was chugging like an obese dugong.

When Valve fucked up and mistakenly lists Two Worlds 2 at Russian prices, they honoured those sales. Same with Canadian Tire. When Starbucks fucks up my order, they settle the breach of sale with a correction and a next-time-free coupon. Even if what I said was bullshit the precedent remains that other businesses own up to their mistakes, and the lucky people who made use of unintentional bargains are not greedy exploiters.

So yes, shame on them.

As for the previous shit they pulled, they once offered a permanent discount available through IGN prime. This 'permanent' discount ended. Fundamentally the same shit, really. I don't trust GG as a vendor. Neither should you.

It was a pricing glitch, you didn't even got a key for it. Don't act like somebody taken away your birthday cake just because you couldn't score another free game. Majority of us can deal with it, you should also try it.

Comment has been collapsed.

You're projecting emotions onto my statement that weren't there. I just said, paraphrased, "Gamersgate fucked up, isn't honouring their fuckup, and they fucked up in the past." Was I annoyed? Yes, wouldn't anyone. Am I dealing with it? Depends how you define 'dealing with it'. I didn't submit a support ticket to complain, but I did comment on an internet forum. Though it was for other people's benefit: to notify them that Gamersgate is not a particularly competent vendor and "sorry I didn't mean to" is not a valid excuse in the adult world.

In their right as in it being their store? sure. Legally however, i would like to know out of curiosity.

Not a decent move atleast, GOG for sure had that occasion a few times and people could keep the game.
Desura also had Chuck's Challenge 3D for free accidently at one point, not sure about any other instances.

Who's the asshole in this scenario?

This isn't people finding the safe in the car dealership that holds all the keys is open, and then making off with the cars. This is the dealership leaving a pile of keys on the front desk next to a sign saying "free cars, take a key, 1 per customer".

The purchase process when the game was free was identical to how it normally is. One may guess that a mistake had been made. But there was no solid evidence at the time for it. As I said, GG didn't make a statement when they should have regarding the invalidity of those redemptions.

So unless you can find in the terms of use saying that Gamersgate reserves the right to retract game licenses as they so please, it was most definitely an open gift, unintended as it may have been. And even if you do find such a clause, that similar vendors either don't have such a clause or don't exercise them as GG did is just another indication that GG is not worthy of patronage.

First adam1224 and now you (and a couple more since I started writing this). I really don't understand how people like you think. Despite being disinclined to put the time or effort into providing a reasoned rebuttal, you are inclined to employ insults and thought-terminating cliches to end the discussion you never needed to take part in.

So because I take academic issue with how a corporation handled an error in their storefront I'm instantly a petulant, entitled and insecure brat. That's good to know.

First off, maybe you didn't pay attention. My contention is that making use of a mistaken price point is not stealing. If you have an actual, logical statement for why I'm wrong, I'm all ears.

Second, if I wanted to 'steal' the game I know how to torrent it. As I said elsewhere, my issue was never that I didn't get it. It's that GG are not behaving as how a good vendor does.

hmm not sure about the country that GOG is based in but in Canada (I'm assuming you're Canadian too), it isn't considered a legally binding contract unless both sides receive something. There are exceptions such as when the receiver was somehow dependent on the freebie they're getting. That said, it would have been good PR to honour those keys.

Permalink

Comment has been collapsed.

True, there is the issue of consideration rendered. However, if the price had simple been, say, 1 cent, would the situation really have changed, logically speaking? And much of the same principles apply to gifts. See my reply to ZerbaDerb.

I must stress that my issue is not so much that Gamersgate ran out of keys, or that I didn't get one because they did. That happens and is to be expected when something is free (Econ 101: supply and demand). My issue is that this vendor made a mistake that lasted for hours and tanked their website, and had the gall to remove the game from the libraries of honest people who had legitimately acquired valid keys.

GOG is from Poland, about 3 times they had a sale and due some bug some games were free, it's not as high priced as Warlock 2 was, and mostly games lower then $10 but still.
Also when someone redeemed a key at the same time as someone else sometimes both parties would get the game.
On both issues everyone could keep their games.

It would be good PR, or atleast give some form of discount like they did on their previous mistakes, personally i don't care either way. But it's weekend so they might still come up with something.
From what i googled on one event people got a discount on any purchase for a year.

And i am from The Netherlands.

This thread turned into a huge pile of shit from what I can see. People writing tickets that they got their game with bugged price/for free removed... I haven't bought a game on GG in months but I'm sure that they STILL are not Valve with infinite amount of money.... Fucking hell...

I hope that they manage to revoke the games from Steam libraries as well.

Pricing errors are pretty much always honored. This is an exception, which is why it annoys people.

I would not say it is an exception with gamersgate being involved. What about the good old Bethesda bundle couple of years ago, bought it for 30 bucks (glitched price instead of 70 bucks) and they have removed those as well, week later they "gave" away free Borderlands 2, revoked again.

Permalink

Comment has been collapsed.

I got to keep my discounted Bethesda bundle when they had the glitch but only because I had managed to redeem most of the keys already. They did honor those purchases as it would have been an even bigger PR nightmare to revoke all those keys. But a lot of people got their games removed from their account too.

This time, I didn't manage to get a key so I didn't lose much, but I won the game on here so I will be watching to see if keys are being revoked or not.

I also see no connection between me not having the game and people being shitty for having their game with glitched price removed. It's not like GG or the devs lost money because of that glitch but yeah, you must have yer fucking copy.

God, what a shitty attitude to have...

That have show me how they deal with this kind of problems.. So from now on i will only access Gamersgate for free stuff. Gamersgate deals? Fk them, not even 75% off or higher deals. I dont care. I have bought a couple of games there before but no more.

Based on previous GamersGate price errors, if you received a key, you're in the clear, if you purchased it, but did not receive a key, they will likely revoke the purchase.

That is what happened with the BL2 4-pack price error.
