For digital distribution of games the rating can be given by the maker itself.
When someone wants to distibute physical copys it would be different because then another paragraph of the youth protection law would apply.
Digital distribution = Self Rating possible (JMStV)
Physical distribution = USK need to be involved (JuSchG)
The max rating is 18+ and if you go for that anyway....
In theory everything unrated is USK 18 by default anyway.

I though in the same way, before communicated directly to USK.
They warned me that I can pay and it's high chance I receive "no rating" due to torture in the game (erotic is not a problem at all).

You do you but USK do not need to be involved and therefore payed if you self rate, which you can for digitial distribution only.
