The difference is that in many cases games from indie gala, indie royale bundles are available on steam as well as drm free downloads. One can giveaway the code and still play a game himself. In case of Be mine 3, you get only the code. If you give it to someone else, you actually lose game you legally bought. So yea, I think in this case the rule is ridiculous and I'm not going to obey blindly. At the end of the day it's about giving something I own to someone who wants it - for free.
