Check to see if they activated the game first; if not, then yes, definitely report

but maybe he activated your copy and somehow found another copy/key in his possession that he is now giving away (which would be fine).

Legal ? Yes.
Forbidden by the SG FAQ/rules ? Yes.
But according to his Steam profile, he have added your game to his library, and then, bought 2 copies of the game for giving away.
