Got this e-mail: "Thank you for purchasing Humble Indie Bundle 16! We're sorry, but we accidentally provided you with the wrong Steam key for Sunless Sea. To correct this error, we have added a new, replacement key to your download page. Within a few days, we will deactivate the previous key."

Never had anything like this happen before. I've checked the bundle page and there's the Sunless Sea key not revealed yet even if I did use it back when I purchased the bundle...

Anyone else had this happening? I'm assuming I'm not the only one, lol.

My steam licences page lists the game as "SUNLESS SEA - LIFETIME EDITION", maybe this second part is the problem?

update: there's a discussion started in official steam forums so you can complain there too! (via dumbname4dumbgame)

When you used the key, the first time, it worked?

If yes, then they provided a whole new brand usable key for Sunless Sea, enjoy!

Can still be revoked later. Had this issue just some weeks ago. While Humble Bundle already provided the new key, steam took 5 more days to remove the old key from my account.

EDIT: Also, you are not punished by steam in any way. It is just the key getting removed.

O M G. A few days ago I saw that this was an exploit, whereas you can redeem two keys with your bundle by revelaing and using the first, and when you reveal the other, it will be different. Looks like this is now fixed, and people, who (ab)used the exploit will be salty.

I've noticed it too the other day when additional games were added, but left it be until I see what is happening... I guess now we know. I'm just afraid Steam does not think we did something wrong and reacts when HIB revokes the keys that are already activated on our accounts.

I think this isn't the first time, that steam has to revoke keys from a bundle. I vaguely remember that something like this already happened.
I would also assume, that HB has consult valve before they do something like this or that they would at least notify them.

I don't think we have to worry!

It's happened a lot in the past mainly for credit card fraud on HB's side, then them revoking all the fraudulently purchased keys. As far as I know Steam doesn't punish anyone for getting revoked keys other than removing said item from your account.

If their key gets revoked all they have to do is contact the ga creator and ask for the other key, the only problem would be for users trying to take advantage of a second key showing up on their page.

It really doesn't help that this email came more than a week after they wordlessly put the second Sunless Sea key in your account.

I redeemed my Sunless Sea on Steam and then saw it unredeemed in my HB account. Not remembering the characters in the first key and thinking it was probably the same key with a glitch in the key masking, I gave it to a friend to try. It redeemed on his Steam account.

So now when they deactivate the first key from my account, I'll be left without the game I paid for.

if you sell a broken car, its is you fault, not manufacturer.
same logic. always apply real world rules/laws to digital content. seller is full responsible for what they sell. doesn't matter at all if they did produce their product.

Permalink

Comment has been collapsed.

Nope, if you buy a faulty new car the manufacturer takes the car back since they manufactured the car and not the dealer you bought it from.

Blaming HB for giving out faulty keys they got from the developer doesn't seem right, they don't have the option to check what the key unlocks.

Permalink

Comment has been collapsed.

not even close. if manufacturer close their doors, seller still takes full responsability for what they sell. if, for some reason, manufacturer refuse to fix your buy (saying, for example, that seller store the product in wrong conditions), seller will have full responsabilities for what they sell. blaming humble bundle is a consequence, since they sold the item, which give to them full responsability for what they sell. this is called risk of the business. seller have responsability for what they sell. costumer don't even have to contact manufacturer. that's how steam works. you make complain about a game to steam. it is their job request providences to devs, not costumers. if costumer open thread in a forum, report bug directly and blablabla they are doing steam job.

Permalink

Comment has been collapsed.

Could you explain to me then why car manufacturers take back cars when there is a fault discovered? You tell the dealer from where you bought the car and if its a production mistake the manufacturer takes back the faulty cars, it happens a lot.

HB has no way of knowing what key they give you since they get them directly from the developers, if the developers send HB a key for a different game by accident you complain at HB and HB gets their new keys from the developer.

Permalink

Comment has been collapsed.

manufacturer and seller share the same responsability. if seller pay for something that wasn't his fault, they can claim it back from manufacturer what they paid to the costumer, since they prove that the problem was not their fault. recall is made by manufacturer because if some seller pay anything for costumers, they can claim it back later. so manufacturers do recalls because they know, in the end, they gonna pay for it.
humble bundle don't have to know if it works or not. they are selling working products, so they assume that it is working when delivered. if it is not working, there's no need at all to contact devs (same logic). sellers are not doing favors to devs or costumers solving the problem. they are doing their job, because they are responsible for it. if the problem was cause by devs, it is seller problems, not costumers.
you basicaly were saying that responsability is relative and someone have to tell who is responsible for what (since sometimes it can be seller fault or manufacturer fault). well... that way is better think that you are the one that choose who will have responsability, because if you won't, seller and manufacturer will refuse to fix your problem and there will be no option left to you but sit and cry.
to understand everything I said, you have to separate the business relationship between manufacturer and seller to the costumer relationship between buyer and seller. their problem its their problem. if something happens, you don't have too look who fault is. I'm a lawyer and I didn't met, so far, any country that did their laws adopting the opposite theory.

This doen't make much sense to me but to get back to the original problem HB received wrong keys from the developer and they are replacing them with new keys which they also got from that same developer. Problem solved. You got what you've paid for.

I think the car metaphor you used is a bit off anyway. Are you talking about a new car or a 2nd hand car? If I sell you a 2nd hand car and it appears to be broken there is nothing you can do about that here in The Netherlands but if you buy a new car you have a thing called warranty. There is no such warranty on games.

Permalink

Comment has been collapsed.

A car manufacturer can't take your car away, neither can the dealership. A recall is just a system to reduce legal liability by voluntarily fixing the vehicle for a known defect. They can offer to buy the car back, but the owner doesn't have to accept the offer.

Humble Bundle is technically putting themselves in a position that creates a liability. They're essentially breaking down your front door and taking what you bought and replacing it with a similar item, just digitally.

You agreed to Humble Bundle's Terms of Service when you bought the bundle which states:

Notwithstanding any other provision of these Terms, Humble Bundle and its licensors reserve the right, without liability to you, to change, suspend, remove, or disable access to any Products, content, or other materials comprising a part of or sold through the Service at any time without notice.

They aren't "taking what you bought and replacing it with a similar item." You received something you didn't pay for and they are taking that back and giving you the game you did pay for.

The portion you are quoting only applies to the content they provide. For example, if HB goes out of business, you can't sue to regain access to the content. They're abusing a fraud feature on Steam to repair a mistake caused by a vendor. It's a critical difference when the service is not owned by the entity. Contract law does not allow permission for companies to violate laws. Just because nobody wants to pay to go to court to gain a judgment, doesn't mean a good faith purchase is not being violated.

Gawronski et al v. Amazon.com
Amazon was sued in part because their ToS said "permanent access," but they also violated consumer protection laws by remotely deleting the ebooks.

This is more like a manufacturer recall, in which the manufacturers (the devs) said, "hey, we messed up. Bring it in and we will give you what you initially paid for."

People did not buy 2 cars for the price of one, they bought one car (a single key). The people that'll have the most troubles are those who attempted to keep their first car, but give away their rental car which was not theirs.

Permalink

Comment has been collapsed.

Laws differ for cars and software. Anyway, a car's warranty is provided by the manufacturer not the dealer that sells it. If the car is broken when you buy it, the manufacturer is a fault, but you deal with it through the dealer. The dealer is just a middle man between you and the manufacturer, just like Humble Bundle is the middle man between these keys and you. If a problem comes up with the car later after buying it, it's still the manufacturer at fault. Just look at what's been going on with VW, they're having to recall nearly 700,000 cars because of faulty software in the emissions equipment. The dealers that sold the cars aren't the ones at fault for selling cars with broken emissions software.

Permalink

Comment has been collapsed.

cars and softwares are products. so same costumer law. there's no such "relative" responsability that someone (probably not you) will choose who is responsible for what. If you read the comment above, you will understand how it works. (reply to prince)

Physical and digital products are two different things. They share some common laws, but also have different sets of laws governing each. For instance, when you buy a car, you own that car and can do whatever you want with it after you've paid for it. When you "buy" a game or other piece of software, you don't actually own the software, you only bought a license to use it, even if it's a physical disk. That software license has its own terms you must agree to if you want to use the software. Digital sales are also governed by the Terms of Service you agree to when purchasing, whether you read it or not. This is from the Humble Bundle's TOS:

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Humble Bundle reserves the right at any time after receipt of your order to accept or decline your order for any reason.

_

Notwithstanding any other provision of these Terms, Humble Bundle and its licensors reserve the right, without liability to you, to change, suspend, remove, or disable access to any Products, content, or other materials comprising a part of or sold through the Service at any time without notice.

No, I believe that you activated the second key - without noticing that it's the second key - and don't have to worry about anything!

Regarding the version, I've saw someone mentioning that there's a "lifetime edition" coming, which includes all of the upcoming dlcs for the game. That's what some of the first keys were for.

Edit: I guess you could check your licenses on steam and see if the game was activated as

Yeah it seems like quiet a mess, seems like people got the keys first then e-mail later...for whatever reason. You would think they would sent the e-mail before replacing the keys?

I do think they need a better system for this like some way to confirm you got the e-mail before sending a new key.All i know is this is going to be one heck of a mess...

But this should also be a lesson to others to be more careful and watchful of keys and if they have been used and if a new one pops up to question why it is there. This will cause a mess here if some did what you did.

Though what is worse is those who may have been traded/bought the key from other sellers and then it gets revoked for there own game but the ones who got the good key will have there game or worse keys they bought/traded for gets revoked.

I wonder if this is more the publisher pushing to fix it?Or maybe Humble has done this before where they revoke keys and give another in its place?

All i am saying most good sellers will just let you keep the game and eat the price glitch or what not?I mean how do people still get the EA backers keys, you would think once it was released all keys would be given and no more created?

So i can only think they where using old keys and realized the old keys where the wrong ones....but still you would think the publisher would say, send me all unsold keys for those, and we will send regular keys.Or Humble would at least ask what to do with them lol

Permalink

Comment has been collapsed.

The publisher admitted they sent HB the EA/Kickstarter keys by mistake and demanded HB to revoke those keys out of respect to their EA backers.

HB gave out the wrong edition for Dropsy last month and decided not to revoke/reissue keys for customers that received the cheaper edition. Pretty hypocritical that they're willing to downgrade, but not upgrade people.

Permalink

Comment has been collapsed.

I can see why the publisher asked that, not just out of respect but also to try and sell more DLC in the future. With that said however, we should be allowed to keep the keys, not only it's not our fault but other devs have allowed that before when a mistake was made as a sign of good will.

When I saw the new unredeemed key, had a feeling something had gone wrong and figured something like this would happen so I kept it just in case but for those that gave it away, it sucks. Most likely they sent a few thousand keys of the Lifetime Edition if that since the mistake didn't last for long or so it seems, the mess that this will cause shouldn't be worth the trouble and bad rep they will get from this.

Permalink

Comment has been collapsed.

Then in this case the publisher should do something to make up for this mess, though i doubt they will. How do you give out the wrong keys?i mean if there where meant for EA backers why were the keys not deleted that were not used?

This is just one of a few reasons i hate digital. In the end imo they should have let those who revealed the keys to keep them and the ones who had not yet,had the option removed until the key was replaced.

They should have just ate the mistake since not all people got it,what are the backers going to do if they bundle the game with all dlc,i do not see how this effects backers,as at some point all the games DLC will i assume be cheap or bundled, then will they still be pissed? If all this version did was give them the dlc for cheap or free and no DLC tied to backers only, then i see little to complain about.

i just feel bad for those who buy it and might have traded/used the key and then a new one appears and they think they did not and trade/sell the good one,and leaving them with a revoked game with no new key.

It is a mess on both sides and a fail on both ends.
