Only way I can see Blizzard prevailing is if there's something in the Warcraft III license agreement that states any user-modified content within WC3 becomes Blizzard property.
And if that does go down... that throws legal strangeness into the modding community for all games. :-\

EXCEPT that it has been tested in court that any IP used in other IPs, or even IPs that are close to in spirit or concept to an IP is a violation of copyright/trademark.

Since dota 2 is based on WoW, its folklore/setting, as well as having characters and abilities the not only function the same but are named the same as WoW and dota 1 Valve would be SOL if Blizzard wanted to pursue it. However, this was brought up MONTHS ago, so this is just a resurrection. Blizzard just wants to fluff a few feathers and show Valve that it sees whats going on, and that it can screw them over if they wanted to. Its mostly for show.

Kind of like if you dealt dope and a new kid walk in and started dealing around your area. You probably wont bust a cap but youd prob tell him off for it.

I haven't read over all of it, but from what I can tell, Blizzard is only opposing Valve's attempt to trademark the name. They're not saying that they own "Dota". They're just defending their right to use the name. If Blizzard wins (and I'd have a hard time imagining them not), it wouldn't mean that Valve has to rename "Dota 2", but it would mean that Blizzard could use the name "Blizzard Dota" for their upcoming game.
