It'll become an issue if people do realize that every word they can pronounce or every thing they could do or even think is copyrighted. Same for ideas, and stuffs. It's rare that only one person thinks about something, "creates" something. Once everything is copyrighted, there is no place anymore for newcomers to think without being called a pirate or a copier.
It's like if kids couldn't make lemon sodas anymore. And what about drawers ? Will have they to always draw new stuffs in case they could go to jail or have to pay shits sueing ? No, really. Funny, since most content creation doesnt benefit the actual creator all that much. Look at most music artists, bands, djs, and so on. Yes they make money, but not that much, a pittance.
Game makers make shit. The actual people that sit down 16hrs a day and write out codes make shit.
Its the big companies and publishers that make 90% of the money.

Please, Nintendo has had plenty of great RPGs on the handhelds, but if we're talking about home consoles Nintendo lost it's the RPGs since the Nintendo 64, and despite what you just said the Wii had good RPGs like Xenoblade, Phantom Brave, and The Last Story.

SNES had a good amount of amazing RPGs and was the golden age of some series like Metroid, Fire Emblem, Mario and StarFox.
I don't think all Wii games are bad, but they doesn't seem to be a improvement on older titles, some actually got worse.

I disagree about it being the golden age of Mario, especially if you consider all of the outsourced edutainment SNES Mario titles not directly made by Nintendo.
It was a mixed bag of awesome games and Nintendo games people try to forget existed. It was also the time when the Virtual Boy came out and became nothing short of a disaster.
I agree that quite a few sequals are not up to snuff on the Wii, such as Metroid Other M, Mario Kart Wii and Mario Party 8, but many of the titles like Super Mario Galaxy were pretty good and plenty of their new IPs still have the charm of older ones without getting much attention (bar Rhythm Heaven Fever and Wii Sports, which are quite popular).
I've been a fan of Nintendo since the NES days and imo they've done quite a bit right in this generation and the previous one (though their handling of the Wii U leaves a lot to be desired).
When it comes to the shovelware that is many of the third-party titles . . . . the NES and SNES had it just as bad with them, they just aren't remembered unless they were especially notorious like Action 52.

as for the LP issue -- LPs are at best <u>derivative works</u> of Nintendo's intellectual property, so they are more than entitled to that ad revenue if they want it. Just adding a few words of your own doesn't change anything -- it's still a derivative work with a significant amount of copied content.
Buying the game does not grant you a license to create derivative content.

First their new WiiU console is only slightly better than PS3 and XBOX 360, this didn't did a lot popularity, and second they still didn't made Mario Kart WiiU or Super Smash Bros. games, normally when you bought Wii for example it came with Mario Kart Wii or another Nintendo game, but now WiiU comes with ZombieU, I don't say this is a bad game since I liked it because saw a playthrough in Youtube, but the thing is some parent or grandfathers goes to market to buy their son or granson a console, since WiiU is a new console and for not really a high price, so when they'll see all blood and terror in game ZombieU they probably won't buy it, and about fans of Nintendo, for example I have Super Nintendo, Game Cube and Wii, my favorite games are Mario Karts, Super Smash Bros. other Nintendo games, and I bought a console because of this and Mario Kart always released with the console at same time for example, so if I would buy a WiiU I would expect get a new Mario Kart game and not ZombieU that is from Ubisoft. Nintendo didn't served their fans the games they liked, and also didn't made a powerful console so like always not a lot of games are on Nintendo devices, ppl accepted it when Game Cube was, when Wiii was, but I think ppl are just tired now, obviously super fans still no, and also they stopped releasing games for Wii as I heard.

So now, if I do an irl video, two hours longer, in which I appear for some seconds in a pikachu cosplay, or just a 'normal' video in which I put at a moment a pikachu picture for one second, all the money I could have got would instead go in nintendo's pockets ? What if someone says or imitates Mario or Pikachu without any picture ?
And they're talking about stuffs like justice, egality and intellectual properties ?

Within the current copyright climate, they are obligated to do this, so I dont blame them at all. However, as for your opinion that games and other media content should be instantly protected and monetized in this fashion I disagree with.
Just because you are using another persons content does not mean that everything you might have added should instantly become theirs. If I make a painting, should the canvas company own a portion of it? If I make a 100 song club mix, toss in some sick beats and bass drops, is all of my work invalidated because I used other content? What about if I write a fan fiction? I didnt create the universe that I am writing about so I should pay whoever did right?
Yes, a game is a self inclosed story, more so now then in the past where most games are mostly on rails and offer little deviation. HOWEVER everyone, even within the same limited environment, manages to play their own way. Much like if you had 30 kids in a room, told them to color/draw for a bit, but you only have yellow pencils. Yes everything is yellow, but how many drew the same thing?
Also, according to current copyright law, though not enforment, LPs are classified as fair use so this SHOULD be illegal. However recent legal trends seem to forget what fair use is entirely making "fair use" some kind of hipster term now, you know, because no one has heard of it, "hue hue".
Now, all of the above might sound like I advocate that all content should be free and some other hippy bs, but thats not true. All the people uploading entire/parts of shows, music, game trailers, cut scenes and so on with out permission or content ownership should be removed IMO. Personal gameplay should not. Remixes and other added content creation should be left alone.

But by your own admissions, you dont feel anyone using another's content should be granted their rights to this made content. LPs fall under the same catagory as speedruns and challenges, walkthroughs, and personal reviews. All of which this would affect in the same way since all use the game as a base to build on.

I totally agree with Nintendo here or any other company that would do the same. After all, LPers are making money off of other companies their IPs and backs without consent. Also, I consider Let's Plays trash content that takes no effort to make, just talking over some gameplay, but each to their own. Make all the LPs you want, but demanding money for it, seems too much for me. While you don't even own the right to broadcast the footage in the first place, since it's literally showing the game being played with someone blabbering over it, no fair use there. Is it a dumb move? Probably

I don't really watch those on Youtube that much, but Nintendo doesn't/shouldn't have performance rights on video games, especially for footage that wasn't recorded by them.

Right now I just want to see if this will only affect trailers and official Nintendo material rehosted on youtube by whoever, ign for example. Or if this will also affect people who are creating fan material using these clips and/or gameplay material. The fan trailers, the let's play, the remixes, that stuff.

Chuggaaconroy has already confirmed that one of his Mario 64 DS videos was claimed. But the way the content ID match system works, it can't really tell the difference between re-hosts and fan-made stuff.

This isnt anything new. Nintendo has always protected their copyrighted material, Intellectual Property, and Mascots. Sad to say it, but Nintendo is in the right here. People making videos of game play must get written consent from the company/people that own the intellectual property in question. Else the person is indeed infringing upon the said copyrights of the company that owns them.
Now I would prefer if they would maybe do some profit sharing. As these let's players are in fact doing Nintendo a service by providing free advertising for their games.
The scary part that I don't really want to think that Nintendo would be capable of: If some let's player or reviewer of a Nintendo product gives a bad review. Nintendo can now charge said youtuber with copyright infringement and put that youtuber out of good standing. Basicly limiting free speech on Youube.
And at least Nintendo isn't being as bullheaded as Sega. Pulling down every video with any gameplay of a sega product. And getting the youtuber screwed out of their good standing.

They're in the legal right, yes, but they're not in the "being a decent person" right. The LPers are giving them free advertising, which is why most game companies don't mind LPers. So not only is Nintendo getting free advertising, the advertisers aren't even being compensated. Just because something is legally right doesn't mean it's good.

Yeah but at the same time I would not mind if the user mad 0 on the videos but its almost like the users are giving Nintendo free promotion and advertising at a point don't you think? I mean when I see a bunch of nice game play clips I am more inclined to buy the game, I really don't feel like Nintendo should make money off other users videos like this...the free advertising should be enough, they should be grateful...

I can understand that. But it's not like Nintendo are forcing people to make the videos. The counter argument to what you said is, what if someone only makes Nintendo related videos and gets paid for them? That's a little bit of advertising for Nintendo, but more advertising for the uploader (obviously this can vary based on how much of themselves they put into the video). But wouldn't you agree that the uploader is using Nintendo to make money without even asking them? Clearly as of now, money is more important to Nintendo than advertising. Which is perfectly normal when sales aren't great.

I guess I feel like no one should be making money on it is all if anything, If anything though I see it as the uploader making some cash and Nintendo getting free buzz as an even trade off and that this little situation will just mean less Nintendo related videos on Youtube which is sorta a shame for both parties if you ask me.
So maybe..no one should make cash off it, if Nintendo wants money off of it they should start throwing up 100's of videos on the devs/testers playing games and doing silly things in game.
Guess its all about perspective though, some might find it fine, I personally find it greedy...

Good on them. It is their content, they are not removing content there. Good move, and it's been coming for a long while.
On the other hand I am one of those that think that monetization in LPs is the worst thing to happen to the hobby, but then again I am also one that thinks that the goddamn LPs should be about THE GAMES, not the player.

Basically any video on Youtube that Nintendo claims that has anything that relates to their game (Mario, Pokemon, whatever they own, such as audio, images, or just the game themselves) won't be removed, but will not only receive ads during the beginning of the video, but the money goes to them instead of the uploader. This means that LPers that focus on Nintendo games will get no money from it and Nintendo will have it all to themselves.
Looks like the sales of the Wii U was not satisfying them, so they are attacking their fans for their money now. Nintendo has steep low this time.
