Funnyjunk tries to sue Oatmeal - This means war!

Stealing from 9gag? LELELLELE TROLOLOL. I doubt anyone wants to steal that.

Funnyjunk has been around much longer than those sites you've mentioned. Granted Funnyjunk, newgrounds, albinoblacksheep, stupidvideos, and ebaumsworld all fed off each other during those times.

I'm not defending Funnyjunk, all I'm trying to say is that it's not their fault that the people who go on their site to submit content happens to take it from other sites. When in reality, it's not the site's fault. It's the people who post on the site.

He's not an idiot. He may not understand the internet as well as some people, but he's not an idiot. He knows the law and how to use it to get what he/his client want. He's suing for defamation; and he obviously thinks he can prove it and that's all he needs to prove; the copyright issue is moot. Whether or not he can prove defamation is another matter.

FunnyJunk isn't the one ripping off TheOatmeal's content, it's FunnyJunk's users who are uploading them. If FunnyJunk is complying with the DMCA by removing infringing material when they are notified about it, they're fulfilling their part of the bargain. From reading TheOatmeal's posts it doesn't sound like he's been making an effort to file DMCA take-down requests (i.e. supplying them with URIs for offending content).

An analogy: a kid in your class has been bullying you for 5 years and you never told anyone, but then turned around and stabbed him to death. Was the kid wrong for bullying you? Yes. Were you wrong for stabbing the guy to death? Yes. Do you have a list of all the times he bullied you in a diary? Yes. Could it all have been avoided if you'd told someone about it to begin with instead of bottling it all up? You bet your sweet bippy.

He'd have been better off asking his legions of fans to enter offending URLs that appeared on FunnyJunk into a web-form on TheOatmeal to help him manage DMCA requests. Instead he seems to be acting like a petulant child. Don't get me wrong I like the guy, like his work and admire him for taking a stand, but if he'd filed DMCA requests/emailed the admin with lists of links at the very beginning, instead of ranting about FunnyJunk in a childish, passive-agressive way, this wouldn't be happening. The only way you can stop it happening is to cooperate, but he chose not to. The only way you can stop FunnyJunk's users from uploading your content to FunnyJunk is to cooperate with....drumroll....FunnyJunk.

All that being said, threatening to sue someone who indirectly contributes content to your site is a stupid move, as well as a dick move.
