I remembered that the planned successor of Prelude was Guardians of Orion, a co-op top down shooter. So just how did it change name and become another FPS?
Regarding this take down, Activision is not entirely in the wrong if they actually created the gun models in BO3 from scratch. Though it's a total jerk move if they don't give any warnings to the dev, if the information they posted on the Community could be trusted

that is just appalling. I did think that if the developers claims here about not being informed are true then Valve could have handled the situation better, but now I'm rethinking it as it seems it's far from the first time such an accusation has been made

Although that is true, they might have done it in fear of losing their job. You don't know their situation, maybe they needed the money for it badly and couldn't afford to lose the job. I know I wouldn't want to work there, but some people might not have much of a choice.

They should though. At least when I saw a reel on how some FPS was made in the early 2000s (or late 90s…? I want to say it was Soldier of Fortune, but maybe that was the game where they really wanted to use voxel graphics, despite current industry trends?), they even mentioned that they had to get into contact with all the manufacturers, this is why their weapons look like the real versions (well, for that time).
Usually there is another way, when the manufacturer contacts the dev/publisher and they put their products in the game as classic product placement. EA was large on that with their sports games line-up.

The game is promising, but the devs rubbed me the wrong way. They seem to empty their emotions, their frustrations about the situation in their posts towards the community. Pointing fingers everywhere, others are responsible, not them. That is not very professional. It gives the clear impression of not being able to take a step back and try to handle the situation as best as they can.
They don't even consider that maybe they should change the gun models somewhat. Remove what is too similar. And just go over the whole game, look if there are things too much inspired (or copied) by existing franchises or something. They are just too busy defending themselves that they do not even consider their own conduct =/

AFAIK there was court case about that, you can use guns design all you want - something like designs are art and you can imitate art.
Difference is, it looks like Orion didn't imitate CoD, they took CoD weapon models (or at least parts of them) and just painted them in different colors - a bit like stealing a statue and throwing paint on it.

Wasn't really making an arguing in favor of the ORION creator... The holosight and the rifle do seem to be heavily based on the one from BOPs3, and they should resolve that. An argument in their favor would go along the lines of pointing out the creator(s) did offer to remove the infringing material but the offer was turned down. That would show that Acti just wanted to beat their d*cks a bit and not resolve the issue.
TL;DR Orion creator made mistake, Activision isn't letting them fix it.

There's also screens showing Orion's weapon to be allegedly put together from bunch of CoD's weapons part.
Seeing how much developer goes with whole issue and actually is known to be a thief who takes stuff from other mods etc., I think Activision just decided to not screw around and show them that thievery ends bad (aka no Steam sales...).
Which would make Activision a good guy, vigilante style... Scary thought :P

Many are complaining about Activision not giving them a heads up before doing this but with the past history that this developer has they aren't owed a damn thing. They are thieves and after reading through some of the comments in this thread about past issues with them there are obviously other issues going on too. I have no sympathy for them at all and I'm not gonna hate on Activision for this one bit.
Threatening a lawsuit, whining about missing out on the biggest sale of the year, and then begging for money isn't helping their cause either.

So apparently Activision has removed ORION from Steam. This was done via a DMCA takedown request stating:
“on behalf of Activision, who alleges that the game Orion uses weapon art content from Call of Duty: Black Ops 3 and Call of Duty: Advanced Warfare. The weapon art in question includes the M8A7 rifle, the Haymaker rifle, and the Bal-27 rifle."
