It is not misrepresenting, and thus not technically against the rules, but it is skirting them. It is defying the spirit of the rules by attempting to receive full value for bundle game purchases.
Fortunately support has marked the franchise pack as a bundle as well.

I don't agree with your assessment. Just because the first two pieces of the pack are in a bundle does not make it "skirting the rules." I know people who make custom franchise packs. For example they have Orcs Must Die 2 Complete and Orcs Must Die 1 GOTY and give them both away as the Franchise Pack.
Actually a better examples is Darksiders Franchise Pack, now that DS1 and DS2 are both on the bundle list. I used the base game keys from Amazon on my own account. I then bought the BTA Humble Weekly Bundle. If I give away the DLC keys from the Amazon Pack and the DS1+2 keys from the HiB in the same giveaway, it's "skirting the rules"?
BTW, support said that Red Orchestra Franchise was added to the bundle list because too many people kept making giveaways for it that did not include the upgrade.

Doesnt matter, Franchise Pack is on the bundle list. Support already preempted this method.
To answer your question, if you buy the Deluxe Upgrade and give that + the HiB, I'm quite sure that is allowed.

There have been few giveaways of Red Orchestra Franchise Packs on top of the normal Humble Weekly Sale GA since Steams Weekend Sale started. But I'm curious if it is actually allowed to build your "own" franchise pack out of those HWS keys and steams standard to deluxe upgrade. This way it is possible to bypass the bundle restriction on the games and get 35 $ CV for of 2,5 $. (actually it's 1,77 € for me, but I'm going to assume the upgrade costs 1.5 $ for the sake of the argument) I'm not implying people are already doing this, just curious if this could become a thing and should be stopped before it becomes a thing.
Also, funny how Red Orchestra is on sale at all. Could this be related to WHS? Discuss
