Yeah I feel your pain man, I didn't know robbing banks was illegal too after seeing people do it in payday2 I just assumed it was legal but luckily the cops totally understood the misunderstanding and explained to me it was illegal then they let me off with a warning but i lost my loot bags to this so I mailed the bank about it hopefully they'll send em back.

It's possible to create a website for more or less anything, and depending on where it's located, it might not even be taken down. Over here there is a growing problem with websites selling narcotics. Clearly illegal, but those sites still operate more or less in the open, because there is nothing that can be done about it.
Also, just because something is against the ToS does not make it illegal. It's fully possible that this is not illegal, but it's also not illegal for valve to close down an account that breaks the ToS over something like this.

I won't say anything against buying steam accounts because it seems others have done that already. Instead I will try to make this a useful post...
You may have bought a hacked/hijacked account which the original owner has every right to try and get back. Anyway, like Sighery said above, you should have changed the email and password right away, because there's always scammers that will try their luck. If you get your money back and try looking for another account to buy, ask the person to hold the transaction for a few days to make sure it is their account to sell.
