Only because that's not how they look to make their profit. Instead it's the sale of trading cards on the Steam market that are masquerading as 'games'. Otherwise make no mistake, they would have no qualms whatsoever about doing whatever it takes, however unethical, to achieve their own ends.

The best thing about owning all of Digital Homicide's games is that they don't cost anything. You can just get a nice +1 in your library, donate some money to Jim Sterling and his lawyer by selling the cards, and call it a day.
The worst part is when you get morbidly curious and actually launch one because "it can't be that bad, right?"
As a side note, I notice that this one is developed and published by "R. Romine". Presumably he's setting it up so that if you take cheap shots at the developer, he can consider it a personal attack.

Here's the thing, though. We all know Romine is going to lose his suit and Jim will be awarded legal fees. Plus, Jim can countersue. And because Romine filed his frivolous harassment lawsuit as a person instead of a company, he's going to be paying out of pocket instead of being able to use the company as a shield.
So really, any money that they make is just going to go back to Jim Sterling.
