Its a copyright issue, not theft and I highly doubt they give a monkies. When BL1 was gamespy anyone could play online, legit copy or not as there was no authentication, they made that decision. It benefits them as its just free marketing for their upcoming BL title.

If they wanted to give out their game for free they can do so on Steam today. They're giving people who already bought it a Steam copy, not scumbags who exploit a pirated copy. It's not even a copyright issue at this point, they're stealing Steam copies.
