In fairness, I don't think there's any site that doesn't require that?
GMG, ScamGala, Humble, and GOG all require it, off the top of my head (though I admittedly wouldn't know if the first two had changed policies at any point, but they at least did used to have the same setup).

Yeah- don't recall about GMG (especially since I think the newsletter thing was mostly tied to their game awards freebies, which they haven't done in YEARS), but the other three should all be forced.
Definitely reasonable to point out, if this is an exception. I think Humble and GOG at least mention the newsletter thing with the same checkbox prompt regardless of whether you're already subbed or not, as you try to claim their freebies, but I don't see a mention of the newsletter thing in my checkout at all (with my being already subbed), so I didn't really have any insights into that process until you pointed out it was different (since I've just left it subbed since they first asked for it years ago).
