Hello,

i have created 3 Giveaways which has already ended. I thought that i could resell my games which i already player because I had in mind that the European Justice Court ruled that you can sell your "used" software.
As i tried to gift the games i noticed that it is still not possible. So what should i do now? I have no gifts to give, can i take my gifts back or should i delete my account here?

I am really sorry but I really thought that you could sell your used software! :(

How can he using - "European Justice Court ruled that you can sell your "used" software" as an excuse is just as bad as using "I didn't know it wasn't allowed" Ignorance cannot be used in the court of law.

I know this isn't the court of law, but one of the main things he is forgetting here is - this site is not European, therefore it does not follow EU Laws & Regulations. It follows those set in place by the US Government.

I think he should just do what other people have already suggested and leave the site, he made a mistake - he didn't read rules and terms so, it's his fail.

The underlining issue here is Steam's platform, not this website.. so;

  1. If steam had followed the EU laws that say software licenses can be resold, then he'd not have a problem gifting his games here and he wouldn't have had to post this.

  2. OP doesn't realise that when you buy something on steam, you actually subscribe to using the game. You don't own the game, you own a subscription to play that game for as long as steam allows. Steam owns the license to the games, and have a contract with the publishers to rent you the game, under a subscription linked to your account, for the asking price.

  3. OP should take the issue up with steam, see point 1.

That really sucks man. It truely is unfair that you cannot trade away games you don't want to play anymore and have payed for but you probably should have checked first.

All you can do now is let the people know what happened and contact support here to let them know it was an honest mistake. If you have some money, maybe buy the winners all an Indie Gala 10 or something to make up for it but you should let them know as soon as possible, it truly sucks when you win something and then do not get it but its even worse when the person just doesn't contact you.

if he doesnt gift the game he put in a giveaway, he will still get banned from here, so the indie gala idea would only be for fairness towards the winners, not a get out of jail free card

They ruled in your favor, yes.
But they never said the software would have to provide the means to do so, so another court needs to get involved etc pp blah blah as usual.

Isn't it stated in the Terms of Agreement of Steam you can't sell them if they are bound to one account (which neither you are allowed to sell/gift). Pretty sure it's in there somewhere, you should read better befor you click on the 'Register/Ok-Button' =/

No they have not. That's just wishful thinking. The EU court ruling did not target Steam, and until the legislature of the EU member states have made new laws in accordance with the court ruling it doesn't matter anyway. Read up on the actual ruling and read up on how laws work in the EU and it's member states before you tell bullshit like 'Steam's terms have been overruled'.

there is 3 thing (Choice) you can do

first easiest thing is to buy those 3 10$ game and gave them to those 3 winner. (30 $ for a mistake is not much)

second don't give them anything and accept 3 bad feedback

third, stop using this account with this site.

if you can nearly fill your tank for $30, your fuel prices are cheap as fuck. In England, it costs me $75-80 to fill up a small ford.

now how can you prove it's the same user? same ip ? my house have 6 different steam account (me, my wife, my 3 kid and my roommate). So how ? I think it's impossible to prove unless the user is saying what his last account was.

If I recall correctly there was something about contacting mods if there is someone else who wants to join sg and uses the same pc as you (so they wouldn't suspend people for multi acc). I can't find it now so it might have changed

You'd probably have to state which accounts are part of the same household and they'll 1+1 it to this forum discussion / whatever status ends up on the other account (I assume they add a comment what people are banned for so other mods can consider on their behalf)

Yes, you can resell/trade games that you purchase on steam... as long as they are in your inventory. As soon as you activate them on your account, you've decided against any further trade/gifting.

Well, you can always buy them and gift them to the winners, you can most probably get suspended if not. Or you can sue Valve and win the trial, but if I were you I woulnd't choose that one, I mea law is in your favour, but suing a HUGE company is not the best way to win I guess

Steam doesn't sell you a game, they sell you a lifetime SUBSCRIPTION to said game. The game is never yours, only the non-transferable right to play it.

any court cannot say what you can or cannot do, just can say what you are or aren't allowed to do. for example you have a right to live but if someone puts a gun to your head and pulls a trigger no Court will help you

As stated in the FAQ/Rules and Guidelines that you of course read thoroughly before making a giveaway:

Please note you cannot gift games from your Steam library. They are permanently attached to your account and not giftable.

Well you're new, if you actually enjoy/want to be a part of this site then just buy the games on the Steam Store and give them to the rightful owners.

Or take bad feedback and never show your face again/learn from your mistakes.

or acquire a steam key from elsewhere, as there are many legitimate retailers who offer games which are to be redeemed and played via Steam.

The giveaways are all cheap games, and Limbo is on sale now, I believe. It'd cost you $22.50 to buy the games right now, or less if you tried to get them on steamtrades from a trader, the games are pretty common so you could probably get all of them for less than $10 total there easily.
