you could get just cause 3 around 11$ on humble store i think some months ago. i bought all surpise boxes in the past and i was ok/happy with them. this one was more than awful. there are no excuses they will understand their mistake from the refunds. if they want to take our money they must deliver.

Don't try to be deep, it has nothing to do with games, nor bundled ones. To gamble SOMETHING means to take a risk, any risk. Gambling = luck-based games with the smaller chance of winning than losing, tied to cardgames, roulette. It's strictily financial gain. money. Based on your definition getting up in the morning is gambling because you start a day without knowing if it will give you happiness or sorrow.
Next time would you at least read what I wrote?

To be fair, it actually can be perceived as gambling - in this case, the gamble is on the subjective perceived quality of the goods, rather than objective monetary value.
Imagine that seasonal cheese bundle sometimes sends you incredible, tasty selections of gourmet gouda and the like, and sometimes sends you 30 cans of expired Cheeze Whiz. Every time you order it, you get $90 worth of cheese - but it's a 'gamble' for the gouda (unless you reeeeally like Cheeze Whiz, and I'm sure some people do).
That being said, it doesn't really matter how you define gambling - Square pre-announced the $60 fancy cheese of the bundle, of course they're going to pack in some cheeze whiz fillers. People who order surprises should take it like a champ, heh.

gambling = game for financial gain, bigger chance to lose than to gain, like roulette, raffles, loterry and such.
Too many people mix them up and then start an arguement on it.
It's a gamble to go out now because if it will rain or not , it's a gamble if the bundle will contain game *I want* - but it's not gambling because the value is set, everyone gets something that would cost more to buy if it wouldn't be for the pack.

Perhaps you think 'too many people mix them' up because those are just your personal definitions? The dictionary and wikipedia (awesome source of always perfectly reliable information that it is, hehe) would seem to disagree.
We're betting our money on a chance at getting back higher 'value' per dollar than we otherwise could. And yes, even with a promise of meeting a certain monetary valuation of the goods, it's still a risk, since MSRP valuation means little to nothing in the digital gaming world of bundles and 90% sales (does anyone ever buy anything for full price from Steam these days)?
But anyway, does it really matter? I like mystery boxes. Buy em if you like gambling on unknown games (or not-gambling if you prefer), don't if you don't. Or buy em for the express purpose of complaining about the prize afterwards, it's all good!

That's not really an argument though. We have the right to request refunds for wares that we know specifically, just if we aren't satisfied with them. Why shouldn't the same rule apply for bundles with unknown content?
And the stores can't argue either: "We promised to deliver ware X, with the value of Y €. We did that, now you have no choice but to keep it".
I agree though, that such surprise/mystery boxes don't make much sense then. So ... why not drop them?
Square Enix could simply sell them like they used to do, outside the EU. Afterwards they could run a simple sale with all games known in the EU.
The reason why they don't do it this way: They know that they profit far more from doing it this way, because not everyone will make use of their right of refund. That they keep running their surprise boxes is the prove that they benefit from doing a deal that customers wouldn't want, if they had the knowledge and choice. And that is the reason why EU customer protection rocks imho.
Despite that I never bought any mystery/surprise box. :D

I don't know where you got the idea that those laws are old. The opposite is true, as the laws have been updated and become more relevant since online shopping became so popular. Afaik the last update happened in June 2014.
You are also wrong about it being a law covering broken stuff. It is indeed a law with the intention to grant customers the right to check and test a product with their very own hands. It is a law to make sure that customers are in full knowledge, before a deal becomes binding. But there are limits and restrictions regarding to which goods those laws apply and how far.
Comparisons with the US aren't really relevant honestly, because here we don't consider your standards to be satisfying. In the US the priorities are always on business, everything else is an afterthought. As we could witness once more today, as Trump undid all carbon-cutting commitments for the coal industry.
