Eigentlich sind die "Angebote" von Gamersgate ja nicht einmal Angebote im Rechtssinne, sondern für sich jeweils nur eine sog. "invitatio ad offerendum", d.h. eine Aufforderung ein Angebot abzugeben.
Folglich macht nicht einmal Gamersgate dir das Angebot und du kannst annehmen, sondern du ihnen und sie können annehmen. Das du schon bezahlt hast ist schlichtweg eine Vorleistung, die keine Bindungswirkung entfaltet. Wenn sie - wie hier - dein Angebot ablehnen und dir das Geld rückerstatten, dann kannst du dagegen nichts machen. Es gibt halt einfach keinen Vertrag und du hast folglich nur Rückforderungsansprüche was dein Geld betrifft. Aber das kriegst du ja ohnehin.
Im Übrigen können die in diesem Fall wohl auch noch anfechten und dann wäre ein Rechtsgeschäft (aber es gibt ja m.E. keins) auch ex tunc, also als von vornherein als nichtig zu betrachten. Auch dann hast du keine Ansprüche. Aber gehe bitte zum Anwalt, wenn dein gesunder Menschenverstand dir hier nicht zur Erleuchtung verhilft. Der freut sich über dein Geld :-)

Das verstehe ich jetzt aber nicht, denn das Angebot gibst doch nicht Du ab sondern Gamersgate, diese bewerben ein Produkt mit einem Preis X und das ist im Endeffekt ein Angebot wie im Katalog und Prospekt auch. Eine Aufforderung zu einer Angebotsabgabe (Ich zahle ihnen xx € dafür) findet hier eindeutig nicht statt, folglich hast Du einen Kaufvertrag abgeschlossen. Die Zahlung ist dann deine Pflichterfüllung der Schuldleistung.

Ein Vertrag mit einem Online Shop gilt aber erst dann als abgeschlossen, wenn beide Parteien die vereinbarte Leistung erhalten haben. Für gewöhnlich kann in der Zwischenzeit das Vertragsangebot von beiden Seiten annuliert werden, solange alle bereits erhaltenen Leistungen zurückerstattet werden.

They've deleted Ghost Recon Future Soldier too, one guy here and another on FB have commented on it unless they're the same person. You won't get keys in Jan. It's a take your money and bugger off situation right now but nobody knows what will happen to people who have redeemed keys, so far the consensus is that nothing will happen to them.

I say that we give them a couple or days, so they can think about what they have done
and return the games to us OR to see if this "additional compensation" is worth it...
If neither of those work, I think we're a community strong enough to let all the others games in the world
know about this so they stop using the website and we see gamersgate.com closed for good

I actually think this is a really bad idea. I activated only one key to Fallout New Vegas (It was the only game I wanted) and I decided to keep the rest for shenanigans. Turns out they refunded me full $28.75 but I still get to keep Fallout New Vegas? That's pretty awesome in a sense. And if they do refund me BL2, I have the Steam Key to one already, which is completely fine by me.

So far for me at least they have only took Borderlands 2 back and refunded that. They never took the Bethesda pack or refunded that though. I did have all of my keys revealed and activated, and in some cases traded :/ for that though except Fallout 3 GOTY.

I already had some of the keys activated or traded myself. (No point in keeping the games I already have) For the rest, I was waiting patiently until january, skipping over deals from the winter sale for those same games.
Everything is still on my account so I can't really complain YET. However I'd like a clear explanation on what's going to happen with keys that have already been activated.
Especially after syaing on Twitter that we'd get our keys mid-january, I felt like it was safe to use those keys since they looked like they would be honoring purchases.

Yeah, I didn't mind with the Borderlands 2 pack since I hadn't received any keys but if they do take the Bethesda pack and I guess get the keys deactivated that's going to leave me with some p***ed off traders to try and deal with who I'm in no position to refund.

What they've done is unethical but not illegal. The only real issue I have is that there are a number of customers who were able to access, activate and trade keys whereas others could not and they still receive a full refund. It means people will feel like the system is unfair and that they lost out even if they got all their money back. Flawed system but I wouldn't expect anything less from such an incompetent company.

What? Why give keys to some people and then make a statement that heavily implies you are honoring the sale ("Because of the high demand on this bundle we have ran out of serials for most of the titles. Unfortunately, we will not get new serials until middle of January next year.") and then refund it? Super big no-no. Well, I rarely use the "I won't be buying from them anymore" rant but right about now I'm pretty fucking pissed, was so happy to make a few big giveaways, now I have to delete the one I already made because GamersGate can't get their own shit together. At least I only made one giveaway so far >.>

I'm confused about what will happen to the two copies I ordered...
Copy #1: I sent away all but two of the games to my brother (we were going to split the cost). I activated one of the games I kept, but the other had no key available. The no key available game has vanished from my library. My brother could only get a key for one of the games I gave him, but all of the games are still in his library.
Copy #2: Was bought as a gift copy and sent to my boyfriend. He received it and the collection was added to his library, but last he checked, he couldn't do anything with it or even see the individual games in the bundle.
As of this morning, I have received one refund email from Gamers Gate. I am so confused...

It's pretty strange, because copy #1 is the one I seem to have gotten a refund for - given that they removed the games I kept from the bundle from my library. :-/
