I just had to pop in and say those people getting run over by their own vehicle were probably doing something stupid to begin with. Every single anti tesla thing I have read into the people were doing stupid stuff they shouldn't have been doing like hitting the brake and accelerator at the same time and expecting the vehicle to stop. Dumb people and smart cars or smart anything just don't mix. I'm not entirely sure how you can blame the vehicle when the person was clearly doing something wrong whether they understood they were doing something wrong or not. Just my thoughts.

Well I am not so sure about that. There was a traffic collision here back in December 2021 that left one person dead and 20 injured, 3 of them severely because a taxi driver was not able to activate the brakes on the car which was speeding of its own volition.
Tesla has been extremely cagey and has not provided any evidence that the car "functioned" normally as it was supposed to, which you would expect ofc but they also have not provided a shred of evidence that the driver did anything wrong and that's where I find that a little shady.
I get that they would not share proprietary data to "prove" the car "functioned as expected" but considering Tesla Model 3 collect data on usage, including footage in the car, I find it hard to believe they wouldn't disclose it if they had any evidence the driver was at fault.
The driver himself was an experience taxi driver. He was not intoxicated in any way according to the investigation and he was not charged.

In the past Tesla has leaped joyously on the opportunity to use the collected data to challenge claims that the car was at fault in accidents but not this time, even though the driver has now filed a lawsuit against them. That in itself shows that there is something odd.

Like I said this is someone hitting the brake while the accelerator is engaged. You do that in any car and it will have a similar effect. The person obviously had auto on while he was eating or playing a game on his phone or some other stupid person thing. There is a very slim chance I am wrong in there but still I am 90% sure the auto drive function was enabled and the dude tried to hit the break which resulted in nothing. I have seen so many videos where some fat moron is on auto playing with their phone or eating and the car runs into something. I have even seen people SLEEPING with auto on or having sex. Believe me man people are stupid and just because he was an "experienced" taxi driver doesn't preclude him from doing something dumb. It's tragic when innocent people die due to some person doing something the wrong way, even unknowingly, but to blame the tool is silly. I don't know if they ever fixed the issues but I'm sure they have. I'm also sure that dumb people will continue to do things they shouldn't like alter Tesla's themselves to find ways to make them to malfunction so they can sue for millions and become overnight celebrities.
Personally I don't care about Tesla beyond the fact that it is a fully electric vehicle company that is doing good because fossil fuels are no bueno. And big oil is far worse than Tesla. I can point you to the BP fiasco in the gulf or any thousands of other disasters far worse than a Tesla failing to stop. When a Tesla fails to stop and sets every oil rig in Kuwait on fire because it's losing a war let me know.

I can tell you from the video that it's not just a guy hitting the brakes resulting in nothing.
He tried for several meters to stop the car by getting closer to parked cars on the street to slow down the car so if he could have just unengaged the auto system, he would have. If he had been checking his email like other morons did, Tesla would have rushed to show that with footage but they did not, proving that there was something wrong with the car and they don't want to take responsibility for it.

I also don't care about Tesla. Fully electric cars are cool. Cars with dangerous features are not.

Regardless it was just an analogy about Disney+ and Disney parks being two completely different entities.

All cars have dangerous features, car's themselves are a dangerous feature. Parts of cars fail all the time, there's no shortage of recalls and lawsuits out there. I'm sorry but the Tesla shaming is out of hand especially when fossil fuel vehicles are far worse all around. And yes I drive an ancient one myself but if I had a choice I'd take a Tesla any day. Maybe the one in orbit will survive reentry and land soundly in my yard. Weirder things have happened.

I'm not arguing and I understand that but my point is still valid. People dumping on Tesla is not cool. Automobiles by their very nature are not safe. When combined with dumb people or just regular people who wig out under pressure they become a disaster. Tens of thousands of people die every year from automobiles and I can assure you Tesla fatalities are negligible on that scale. Until there is an adaptive AI powerful enough to actively scan and react to everything in the environment while monitoring all vehicle systems for signs of possible failure and ordering proper maintenance on a vehicle with redundancies on all critical components there will always be vehicle fatalities. And even in that utopian scenario stupid people will still find a way. I'm only offering my thoughts. Take them how you want them.

That's really what they should have argued. Not to mention trying to dismiss the suit makes it a much bigger story. One that keeps putting a highlight on the fact someone died at a restaurant on their premises, which is not going to see any one eating there any time soon.

I mean look, as someone who has worked in professional kitchens for over 20 years, I get it. It's a juggling act and mistakes happen and they have dire consequences. But for a multi billion company trying to just dismiss it like nothing wrong happened is just horrendous and the wrong move

Pretty sure in EU they would be laughed out of the court for something outlandish like this. Any TOS is never above law. IF the employees truly did not take into consideration allergens and gave him food which killed him, it is negligent murder, if not outright murder. You would have to be near braindead to consider signed TOS as grounds to have that dismissed. The restaurant would need to be closed forever and ordered to pay compensation and the owner blacklisted ever from owning another franchise. Disney should pay some good amount as well just for the sake of giving them a lesson of keeping track of who operates on their premises.

TOS can merely save the company from a visitor doing something outright against rules. If this guy would have approached buffet and ignored allergen signs, then obviously it would be his fault. So it baffles me what even is the train of thought for the lawyers of disney. This is probably just a try to game American weird judicial system of being able to win whatever outlandish claim you want if you have enough lawyers and money in your pockets.

I think the issue is they already tried for a settlement but the widower won't hear it and is determined to sue them and raise the profile of the issue, to force them into action instead of buying people's silence.
They are not doing themselves any favor though. What they should have done is recognize there was a problem, take steps to fix it (like a well publicized staff training program for any restaurant operator to get a license on their parks) and launched an awareness campaign about food allergens.
Instead they are painting themselves as a greedy corporation that is trying to evade responsibility in a perfectly avoidable death.

After being online since the internet came into being I tend to not believe 80-90% of what is posted online. This reads like tabloid nonsense to be honest. Don't get me wrong there is a lot of crazy out there but typically not from billionaire companies because they have serious legal teams who know shit like this would not fly in federal courts. You need to go down to county courts with Earl and Nadine to see stupid shit like this. Where people believe they can cram some peanut butter in their ass and dig it out in the middle of court to eat it so they can plead temporary insanity believing they will spend a few months in a day spa then check themselves out when actually they are more than likely still going to prison where everyone will call them shit eater or worse spend a few decades doped out of their minds not even knowing who or where they are because they pulled some stupid stunt. I mean you can believe what you want but honestly shit like this don't fly in the big leagues.
